Summary:Isabelle Schoemann (ETUI) comments: "Attached you will find the consultation document of the Commission of Friday 10 April 2015 on the follow up of the Fitness check on 3 Information – Consultation directives: the general framework directive, directives on collective redundancies and transfers of undertakings. This is the 1st phase consultation according to Art. 154 TFEU to European social partners: ETUC, Business Europe, UEAPME and CEEP. They have until 30 June 2015 to reply. A recast is envisaged: a new, single directive incorporating substantial amendments of the 3 directives and the unchanged provisions. This new legal act should repeal and replace the 3 directives in question. Objective: to test whether social partners would go along the lines of consolidating 3 (much different directives) into one single directive at least for the sake of ‘standardised’, ‘synthesised’ definitions with reference to the definitions of Information and Consultation in the EWC and SE directives (‘endorsed’ by the social partners) whereby these do not include the reference to ‘information and consultation in the view of reaching an agreement’ as in dir. on the general framework 2002/14. The issues related to the scope of the directives and the (lack of) coverage of public sectors administration might be included in the pending revision/recast exercise, whereby the issue concerning the coverage of seafarers and SMEs should not be included as they are respectively dealt with in a Commission proposal of 2013 for seafarers, and do not seem to need any revision in respect of thresholds for setting up Information and consultation bodies in SMES."
